Warranty and Indemnification
Ortec, Inc. production is warranted to meet specifications as set forth in the contract or service agreement between the Customer and Ortec, Inc. By accepting Ortec, Inc. production conditions, Customer agrees to the limitations set forth herein, assumes all responsibility for the proper use of the Customer's products in accordance with these limitations, and agrees to indemnify, defend and hold harmless Ortec, Inc. from and against all claims, suits and/or liability in the event such products are used in a manner contrary to these limitations. Ortec, Inc. hereby disclaims any and all warranties, liability and/or responsibility as regarding use or application of Customer products in a manner contrary to the way they are intended to be used. Any use or application of Customer products in a manner contrary to the intended nature of the products shall be at the user's sole risk and responsibility. Ortec, Inc. shall be relieved of any and all warranties, liability and responsibility set forth in any agreements or contracts if Customer products are used in a manner for which the Customer products are not intended.

These limitations may not be modified, affected or superseded by Customer, nor by any language, term or provision contained in Customer's purchase order, confirmation or other correspondence or communication. Only an Ortec, Inc. company officer may alter or agree to terms that differ from the information set herein.
